These Terms of Use were posted on 12/01/2014. Please look here for any updates, which will be posted for your review.

Tagmmer's products and services are provided by SAS Tagmmer. These Terms of Service ('Terms') govern your access to and use of Tagmmer's website, products, and services ('Products'). Please read these Terms carefully, and contact us at contact@tagmmer.com if you have any questions. By accessing or using our Products, you agree to be bound by these Terms and by our Privacy Policy.

These Terms of Use are governed by French law exclusively.

SAS Tagmmer reserves the right to, and will not be liable to any user or third party, for doing the following:

changing the Terms at any time;

changing the Websites or Services, including terminating, eliminating, supplementing, modifying, adding to or discontinuing any content, functionality, promotion, data on or feature of the Websites or Services or the hours that the Websites or Services are available; or

changing any fees or charges in connection with the use of the Websites or the Services.

Notification Procedures and changes to these Terms: Tagmmer reserves the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if we so choose. We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you. By continuing to access or use the Products after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Products.

Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Tagmmer without restriction. Any attempted transfer or assignment in violation hereof shall be null and void

Entire Agreement/Severability: These Terms, together with the Privacy Policy and any amendments and any additional agreements you may enter into with Tagmmer in connection with the Products, shall constitute the entire agreement between you and Tagmmer concerning the Products. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Tagmmer's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.


1. USING TAGMMER

You may use our Products only if you can form a binding contract with Tagmmer, and only in compliance with these Terms and all applicable laws. When you create your Tagmmer account, you must provide us with accurate and complete information as required during the sign up process. Any use or access by anyone under the age of 13 is prohibited. If you open an account on behalf of a company, organization, or other entity, then (a) 'you' includes you and that entity, and (b) you represent and warrant that you are authorized to grant all permissions and licenses provided in these Terms and bind the entity to these Terms, and that you agree to these Terms on the entity's behalf. Some of our Products may be software that is downloaded to your computer, phone, tablet, or other device. You agree that we may automatically upgrade those Products, and these Terms will apply to such upgrades.

Subject to these Terms and our policies, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Products.


2. YOUR CONTENT

Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Tagmmer. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Tagmmer, you do so at your own risk and you agree that Tagmmer will have no liability arising from your use of or access to any third-party website, service, or content.


3. THIRD-PARTY LINKS, SITES, AND SERVICES

Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Tagmmer. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Tagmmer, you do so at your own risk and you agree that Tagmmer will have no liability arising from your use of or access to any third-party website, service, or content.


4. TERMINATION & INDEMNITY

Tagmmer may terminate or suspend this license at any time, with or without cause or notice to you.
If you use our Products for commercial purposes in violation of our Terms of use, as determined in our sole and absolute discretion, you agree to indemnify and hold harmless Tagmmer and its officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), in any way related to (a) your access to or use of our Products, (b) your User Content, or (c) your breach of any of these Terms.


5. DISCLAIMERS

The Products and all included content are provided on an 'as is' basis without warranty of any kind, whether express or implied.

TAGMMER SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

Tagmmer takes no responsibility and assumes no liability for any User Content that you or any other user or third party posts or transmits using our Products. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.


6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAGMMER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PRODUCTS; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PRODUCTS, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL TAGMMER'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PRODUCTS EXCEED ONE HUNDRED EUROS (100.00€).


COPYRIGHT POLICY

These Copyright Policy were posted on 12/01/2014. Please look here for any updates, which will be posted for your review.

Tagmmer respects the intellectual property rights of others and expects its users to do the same. It is Tagmmer's policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Tagmmer will respond expeditiously to claims of copyright infringement committed using the Tagmmer website (the 'Site') that are reported to Tagmmer's Designated Copyright Agent, identified in the sample notice below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Tagmmer's Designated Copyright Agent. Upon receipt of the Notice as described below, Tagmmer will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site. DMCA Notice of Alleged Infringement ('Notice').

Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.

What if I receive a Copyright Complaint (DMCA) notification?

If you receive a notification that content has been removed due to a copyright complaint, it means that the content has been deleted from Tagmmer at the request of the content's owner. If you want us to forward the information from the Copyright Complaint notification, just reply to the notification to let us know. We'll be happy to send it along (without any personal contact information). If your account receives too many copyright complaints, you may lose the ability to add new content on Tagmmer, and your account may be disabled completely.

If you believe a coontent was removed in error, you have the option to file a counter-notice by following the steps below. When we receive a valid counter-notice, we will forward a copy to the person who filed the original complaint. If we do not receive notice within 10 business days that the submitter of the original complaint is seeking a court order to prevent further infringement of the content at issue, we will remove the complaint from your account's record, and we may replace the content that was removed.

Note: There are legal and financial consequences for fraudulent and/or bad faith submissions. Before submitting a counter-notice, be sure that you are the actual rights holder of the removed content or that you have a good faith belief that the material was removed in error, and understand the repercussions of submitting a false claim.

How to File a Counter-Notice?
Email your counter-notice to contact@tagmmer.com and Include ALL of the following:
Your name, address, and telephone number.
DMCA ID printed at the bottom of the notification email.
The source address of the content that was removed (copy and paste the link in the notification email).
A statement under penalty of perjury that you have a good faith belief that the content was removed in error.
A statement that you consent to the jurisdiction for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Tagmmer may be found, and that you will accept service of process from the person who provided the original complaint under subsection (c)(1)(C) or an agent of such person.
A physical or electronic signature (for example, typing your full name).


PRIVACY POLICY

1. WHAT INFORMATION DO WE COLLECT?

We collect information in a few different ways:

When you give it to us or give us permission to obtain it.

When you sign up for or use our products, you voluntarily give us certain information. This can include your name, profile photo, documents, content, Tags, comments, likes, email address you used to sign up, and any other information you provide us. If you're using Tagmmer on your mobile device, you can also choose to provide us with location data.

You also may give us permission to access your information in other services. For example, you may link your Facebook, LinkedIn, Google+ or Twitter account to Tagmmer, which allows us to obtain information from those accounts (like your friends or contacts). The information we get from those services often depends on your settings or their privacy policies, so be sure to check what those are.

We also get technical information when you use our products.

These days, whenever you use a website, mobile application, or other internet service, there's certain information that almost always gets created and recorded automatically. The same is true when you use our products. Here are some of the types of information we collect:

Log data. When you use Tagmmer, our servers automatically record information (“log data”), including information that your browser sends whenever you visit a website or your mobile app sends when you're using it. This log data may include your Internet Protocol address, the address of the web pages you visited that had Tagmmer features, browser type and settings, the date and time of your request, how you used Tagmmer, and cookie data.

Cookie data. Depending on how you're accessing our products, we may use “cookies” (a small text file sent by your computer each time you visit our website, unique to your Tagmmer account or your browser) or similar technologies to record log data. When we use cookies, we may use “session” cookies (that last until you close your browser) or “persistent” cookies (that last until you or your browser delete them). For example, we may use cookies to store your language preferences or other Tagmmer settings so you don‘t have to set them up every time you visit Tagmmer. Some of the cookies we use are associated with your Tagmmer account (including personal information about you, such as the email address you gave us), and other cookies are not.

Device information. In addition to log data, we may also collect information about the device you're using Tagmmer on, including what type of device it is, what operating system you're using, device settings, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you're using and its settings. For example, different types of information are available depending on whether you're using a Mac or a PC, or an iPhone or an Android phone. Our partners and advertisers may share information with us

Sometimes our partners may let us collect information when you use their services, or may share with us the information they collect. For example:

Some websites or apps use Tagmmer features like our “Tag it” button. If so, we may collect log information (described above) from those sites or apps.

Online advertisers typically share information with the websites or apps where they run ads to measure and/or improve those ads. We also receive this information, which may include information like whether clicks on ads led to purchases or a list of criteria to use in targeting ads. 2. HOW DO WE USE THE INFORMATION WE COLLECT?

We use the information we collect to provide our products to you and make them better, develop new products, and protect Tagmmer and our users. For example, we may log how often people use two different versions of a product, which can help us understand which version is better.

We also use the information we collect to offer you customized content, including:

Suggesting content or boards you might like. For example, if you've indicated that you're interested in education or visited business websites that has Tagmmer features, we may suggest education-related content, boards, or people that we think you might like.

Showing you ads you might be interested in.

We also use the information we collect to:

Send you updates (such as when certain activity, like re-Tag or comments, happens on Tagmmer), newsletters, marketing materials and other information that may be of interest to you. For example, depending on your email notification settings, we may send you weekly updates that include content you may like. You can decide to stop getting these updates by updating your account settings (or through other settings we may provide).

Help your friends and contacts find you on Tagmmer. For example, if you sign up using a Facebook account, we may help your Facebook friends find your account on Tagmmer when they first sign up for Tagmmer. Or, we may allow people to search for your account on Tagmmer using your email address.

Respond to your questions or comments.

The information we collect may be “personally identifiable” (meaning it can be used to specifically identify you as a unique person) or “non-personally identifiable” (meaning it can't be used to specifically identify you). We use both types of information, and combinations of both types, as described above. We may use or store information wherever Tagmmer does business, including countries outside your own.


3. WHAT CHOICE DO YOU HAVE ABOUT YOUR INFORMATION?

Our goal is to give you simple and meaningful choices over your information. If you have a Tagmmer account, many of the choices you have on Tagmmer are built directly into the product or your account settings. For example, you can:

Access and change information in your profile page at any time, choose whether your profile page is available to search engines, or choose whether others can find your Tagmmer account using your email address.

Link or unlink your Tagmmer account from an account on another service (e.g., Facebook or Twitter). For some services (like Facebook), you can also choose whether or not to publish your activity on Tagmmer to that service.

Create or be added to a chared board. Shared boards are visible to you and other participants in the board, and any participant may choose to make the contents of the board available to anyone else. For example, another participant may invite someone else to the board, make the board available to an app they use to view Tagmmer, or even just take an image from the board and email it to their friends.

Choose whether Tagmmer will be customized for you using information from off-Tagmmer websites or apps. If you have a Tagmmer account and want to control how your off-Tagmmer data is used to tailor your experience, you can visit your account settings and update your preferences. If you don't have a Tagmmer account, or don't want us to customize Tagmmer for you when you're signed out, you can opt out here.

Close your account at any time. When you close your account, we'll deactivate it and remove your content and boards from Tagmmer. We may retain archived copies of your information as required by law or for legitimate business purposes (including to help address fraud and spam).

You may have choices available to you through the device or software you use to access Tagmmer. For example:

The browser you use may provide you with the ability to control cookies or other types of local data storage.

Your mobile device may provide you with choices around how and whether location or other data is shared with us.

4. HOW AND WHEN DO WE SHARE INFORMATION?

Tagmmer is a tool people use to organize, share and even showcase their content. When you create public themes and public boards, anyone can view them. You may also provide us with profile page information that anyone can view. The other limited instances where we may share your personal information include:

When we have your consent. This includes sharing information with other services (like Facebook, Twitter, LinkedIn or Google+) when you've chosen to link to your Tagmmer account to those services or publish your activity on Tagmmer to them. For example, you can choose to publish your content to Facebook, Twitter or LinkedIn.

We may employ third party companies or individuals to process personal information on our behalf based on our instructions and in compliance with this Privacy Policy. For example, we may share data with a security consultant to help us get better at identifying spam or with our accountants to make sure we're keeping the books right. In addition, some of the information we request may be collected by third party providers on our behalf.

Online advertisers typically use third party companies to audit the delivery and performance of their ads on websites and apps. We also allow these companies to collect this information on Tagmmer.

If we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of the public, any person, or Tagmmer; or to detect, prevent, or otherwise address fraud, security or technical issues.

We may engage in a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding that involves the transfer of the information described in this Policy.
We may also share aggregated or non-personally identifiable information with our partners, advertisers, or others. For example, we may tell an advertiser on Tagmmer how many people retaged something they shared, or the percentage of people who click on a tag after viewing it.


5. OUR POLICY ON CHILDREN'S INFORMATION

Tagmmer is not directed to children under 13. If you learn that your minor child has provided us with personal information without your consent, please contact us.


6. HOW DO WE MAKE CHANGE ON THIS POLICY?

We may change this policy from time to time, and if we do we'll post any changes on this page. If you continue to use Tagmmer after those changes are in effect, you agree to the revised policy. If the changes are significant, we may provide more prominent notice or get your consent as required by law.


ACCEPTABLE USE POLICY

Tagmmer is a place to organize, share and even showcase any content. To make sure people feel safe and comfortable here, we require everyone to agree to and follow these rules.

Different people may have different opinions on how we should enforce these rules, so we've included example content to help show where we draw the line with our policies. However, these things are rarely black and white—for each content we have to consider the image itself, as well as the surrounding context (like its description or the website the content came from). 

Please note the example public content we show might be disturbing to some people.


1. STUFF YOU CAN'T POST

You aren't allowed to post anything that:

- Is sexually explicit or pornographic, exploits or presents minors in a sexual way, or promotes adult sexual services
- Creates a genuine risk of physical injury or property damage, credibly threatens people or public safety, or organizes, encourages or celebrates harm
- Promotes self-harm, eating disorders or hard drug abuse
- Attacks, bullies or harasses nonpublic people
- Is gratuitously violent or gory
- Infringes anyone's intellectual property, privacy or other rights
- Is fraudulent or deceptive
- Is someone else's personal information or requests a minor's personal information
- Contains any information or content that's illegal


2. STUFF YOU CAN'T do

You also aren't allowed to:

- Use Tagmmer's name, logo, trademark or branding without our consent
- Access, tamper with or use non-public areas of Tagmmer, our systems or our technical providers' systems
- Break or circumvent our security measures or otherwise test the vulnerability of our systems or networks
- Use any method to access, search, scrape, download or change Tagmmer or anything on it (software and tools provided by Tagmmer or popular browsers are okay)
- Add large amounts of unwanted or repetitive stuff, post unsolicited commercial messages in comments, descriptions, etc., or try to artificially boost views, tags, comments or other metrics
- Use meta tags, hidden text or metadata with our trademark, logo, URL or product name without our written consent
- Use Tagmmer user information to forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use Tagmmer to send altered source-identifying information
- Try to reverse engineer any of Tagmmer's software
- Try to interfere with any Tagmmer user, host or network, for example by sending a virus, overloading, spamming or mail-bombing
- Collect or store personally identifiable information from Tagmmer or its users without their permission
- Impersonate or misrepresent your affiliation with any person or entity
- Do anything that violates applicable law or regulations
- Share your password, let anyone access your account or do anything that might put your account at risk
- Sell your username or otherwise transfer it for compensation
- Create or show ads that look like or could be confused with Tagmmer content (for example, embedding Tagmmer actions like tag, follow or unfollow in your ads)
- Directly compensate users for adding content, following or unfollowing
- Encourage or help anyone do any of the things on this list

We may remove anything for any reason, including if we think it goes against any of these rules or our Terms of Service.
